Lead Counsel, Litigation Services

The Litigation Services Attorney job family is responsible for managing Insurance Defense and Tort Litigation / Disputes work and related issues/matters

Key Responsibilities:

  • Supervise direct reports, attorneys, paralegals and administrative assistants
  • Write and conduct performance reviews of team members, including checkpoints and Peromance Development Summary
  • Provide coaching and support to team members
  • Perform quality file reviews
  • Work as part of management team with Managing Attorney.
  • Review new file assignments and approve initial pleadings, propound discovery, and/or develop strategy
  • Contact clients to discuss their case and answer any questions
  • Contact claims (initial litigation plan, recurring minimum 90 day contact, strategy conferences, etc.)
  • Review all documentary evidence
  • Prepare witnesses and clients for depositions, arbitrations, mediations and trials including expert witnesses
  • Conduct depositions and examinations under oath and prepares summary documents
  • Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.)
  • Conduct settlement/dispositive proceedings (e.g. mediations, arbitrations, etc.)
  • Try and/or arbitrate cases and prepares motions in liminie and summary documents
  • Draft post-trial motions
  • Prepare for and participate in appeals
  • Provide legal opinions to claims clients
  • Investigate and pursue subrogation litigation as appropriate  
  • Second chair cases with Trial Attorneys and Senior Trial Attorneys as needed.                                                                                
  • Participate in business process reviews with claims clients
  • Monitor allocated legal expenses, track factors that drive variations, and collaborate with claims clients regarding status of contributing factors

  • Play a lead role in working with senior management to develop and implement change
  • Rely on employees’ own business knowledge to influence strategy/practices
  • Determine if/how business processes / practices need to be modified and work with client implement change
  • Determine extent of other AOR involvement; work with other areas of responsibility that may be impacted to manage change
  • Collaborate and align regarding strategy determination, action planning, and communication with client, business units, and other areas of L&R, as appropriate
  • Displays advanced knowledge of specific legal discipline to connect work back to business results; develop employees’ discipline specific knowledge
  • Project Management
  • Provide portfolio management of employees’ projects; nurture coordination and collaboration between legal teams within L&R and with business clients, as appropriate; search for and implement cooperation between teams
  • Management of Outside Counsel
  • Perform bill/file reviews and perform budget oversight
  • Evaluate and recommend if outside counsel should be retained
  • Retain, supervise, manage, and coordinate work with Outside Counsel, if applicable
  • Interpersonal/Communication/Management
  • Attend board and committee meetings, as appropriate
  • Participate and prepare for meetings with external parties
  • Participate in meetings with senior management team
  • Participate in relevant external industry groups
  • Develop employees through complex “stretch” projects/assignments

  • Administers company Human Resources policies
  • Legal Advice and Counseling
  • Accountable for due diligence; delegates due diligence responsibilities to Law Clerks, Paralegals and/or other Attorneys
  • Research (and lead employees who research) and determine applicable and pertinent laws, statutes, regulations, rules, and other legal authority; conducts risk analyses on key issues; relies on employees to identify and prioritize new issues
  • Leverage extensive knowledge to monitor and review new laws, regulations, and case law; identify and summarize relevant issues; Collaborate with other areas of L&R department; Proactively provide advice, and work through employees to provide advice, and counsel to business unit on the impact of new laws on business
  • Empower employees to provide advice and/or legal approval related to company documents, policy, practices, and procedures independently
  • Provide advice and counsel clients on emerging legal issues and risk
  • Counsel clients and employees on strategic initiatives and serve on project teams as needed to provide legal advice
  • Drafting and Negotiation
  • Develop best practices for employees to review and revise business cases and supporting documentation
  • Accountable for draft, review and / or negotiations of complex matters and agreements; delegate negotiation responsibilities to direct reports
  • Draft and / or review non-routine correspondence and communications

Education and Licensing:

  • Possesses a juris doctorate and a license to practice law in California 

Other Requisites: 

  • 10+ years related experience typical
  • Insurance Defense experience 
  • Proficient skills/abilities/experiences in the following areas: legal knowledge, business knowledge, issue management, analytical skills, influencing others, coaching and development, self development, and productivity
  • Advanced knowledge of professional standards, methods and concepts and the ability to direct functional strategy
  • Computer skills, including MS Office suite, used in or related to the tasks performed
  • Exercises discretion and maintains confidentiality of sensitive information
  • Demonstrates ethics and integrity
  • Has relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization
  • Insurance-industry experience preferred
  • Knowledge of legal holds and discovery processes
  • Able to manage a team and work through others to complete complex projects
  • Works with employees on professional development and business acumen

Compensation offered for this role is $122,000.00-$185,000.00 and is based on experience and qualifications.
