Director, IP Legal

Remote (United States)

NetApp, a multi-billion dollar technology leader and highly sought-after employer, is adding an IP attorney to join its award-winning legal department.

The successful candidate will support the company’s patent and IP litigation functions. S/he will be responsible for building a strategic patent portfolio and advising on IP-related matters, managing IP litigation as the company develops its next generation technology in enterprise and cloud-based data storage, management, and services.

This attorney will work closely with the Company’s technical and business organizations to protect its innovations.

This position is based in the Company’s RTP office, NC. Other locations will also be considered.

This attorney will have at least 10 or more years of experience in intellectual property law, including IP litigation, drafting and prosecuting patent applications in hardware and software technologies. 

Area of Responsibility

  • Implementing and defining the company’s patent portfolio and strategy to firmly align with the Company’s business priorities.
  • Working closely with engineering and product teams to identify and harvest strategic inventions.
  • Managing IP litigation in US District Courts, ITC, IPRs, and other IP proceedings.
  • Managing outside counsel in the filing of new patent applications before the USPTO and other patent agencies internationally in prosecuting active cases.
  • Conducting and leading validity analyses and infringement analyses.
  • Identify existing and future projected competitors and assist IP group to develop mitigation strategies (e.g., patent acquisition, cross licenses, etc.).
  • Identifying and managing defensive publication opportunities. 
  • Supporting IP transactions and due diligence.


  • BS in Electrical Engineering or Computer Science. JD with at least one state bar membership in the US or an EU country.
  • Strong understanding of US patent laws required. USPTO registration preferred.
  • At least 10 years’ experience in intellectual property law, including IP litigation, IPR, drafting and prosecuting patent applications in hardware and software technologies in the US and other countries, and management experience.
  • Strong background in SaaS and in software patenting in the US and internationally. 
  • Strong personal communication skills, both written and oral. 
  • Strong work ethics and self-starter, with a growth mindset, in a fast paced environment.
  • Strategic thinker but can also be detail oriented.
  • Flexibility in working hours in a global enterprise.
  • Ability to travel domestically and internationally to visit R&D sites required.
  • Ability to thrive in a high performance and fast-paced environment.
  • Ability to prioritize effectively and execute quickly with excellent judgment.
  • Solution-oriented and excellent problem-solving skills.

USA Residents Only:

The base salary hiring wage range for this position which the Company reasonably and in good faith expects to pay for the position in the specified geographic areas or locations, is [$205,000] – [$300,000. Final compensation will be dependent on various factors relevant to the position and candidate such as geographical location, candidate qualifications, certifications, relevant job-related work experience, education, skillset and other relevant business and organizational factors, consistent with applicable law.
