Working as an attorney, you will be a key member of the Process Automation business team.


In this role, you will be accountable primarily for contract and legal document review as well as other legal activities for the Process Automation Business Area in NAM (North America). Work requires ensuring all contract management activities are executed in accordance with ABB Group/Division/Business Unit directives and instructions including Company procedures and the Contract Management Framework.

Your responsibilities

  • Contract portfolio: Contract management
  • Ensure the portfolio of contracts in the business follow contract and claim management methodologies in accordance with ABB standard procedures
  • Tender preparation and negotiations: Reviews and comment on commercial and technical tender terms and conditions as part of ABB’s Legal and Integrity (L&I) Team. Develop contract strategy based on customer requirements, ABB’s policies and the overall execution strategy considering risk, pricing, scope and schedule. As necessary, negotiate contracts with customers and working with L&I to develop negotiation strategy
  • Contract execution (from project kick off to project closure): When necessary, identify the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk. Support operations with timely and accurate execution of commercial aspects in portfolio of contracts (that is, payments, claims, variation orders, warranties, provisions, guarantees, etc) and assist in resolving disputes
  • Contract and claims: Support operations to establish and enforce standard change methodologies in portfolio of contracts to identify changes and quantify the additional time and compensation due to ABB per the contract. Define approval requirements and communicate changes to the customer. Enforce and defend ABB's contractual interests against customer and suppliers during the whole of a project life cycle, including monitoring and assessment of changes and deviations and support the defense and enforcement of claims with L&I. Support L&I handling formal dispute resolution, litigation and arbitration
  • Purchasing: Support drafting of Purchase Orders, Contracts and Subcontracts and ensures that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow down of main contract terms
  • Risk Management: Analyze prime contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds within ABB’s Risk Review process. Seek advice from L&I to draft, negotiate and finalize agreements during the Sales and Project Execution phases. Develops and implements risk mitigation and opportunity plan in concert with Project Manager and/or Sales Manager
  • Insurance: Seeks advice to ensure that contract insurance provisions are adhered to and coordinates with Insurance Risk Management regarding occurrences that may be covered by customer or ABB provided insurance
  • Export controls: Seeks advice from Legal (Export Control) to ensure accurate handling of all export control matters and ensures close review of all contracts and projects with regard to restrictions on exports, considering countries, customers or products involved and the respective laws and ABB regulations
  • People leadership and development: Ensure (with HR Manager support) that the area of responsibility is organized, staffed, skilled and directed. Guide, motivate and develop direct/indirect subordinates within HR policies


Your background

  • A Law Degree from an accredited school is required and minimum 3 to 5 years of ownership & performance experience in industrial projects environment with hands on knowledge of contract management
  • Demonstrated focus on Safety, Integrity, Quality and Customer relationship
  • A collaborative, solution focused growth approach, with strong communication, trust and relationship building skills in a fast paced environment
  • Sound knowledge of the key business environment and growth drivers of mining with innovation & speed
  • Demonstrated experience in operational execution and tactical responsibilities
  • Some experience with US Government Contracting requirements is a plus
  • Candidates must already have a work authorization that would permit them to work for ABB in the US
